The Federal Trade Commission (FTC) has asked the US Food and Drug Administration to allow the generic versions of its generic anti-impotence drug Viagra to be sold in the US by mail.
The FTC is considering whether to allow mail-order generic versions of the popular drug to be sold by mail at retail prices.
The move comes after the FTC in a lawsuit filed in federal court in San Diego, California, found that the FDA had applied for several antitrust and trademark challenges.
In a letter to the FTC, Justice Department’s top federal prosecutor, Tom F. MacLeod, wrote: “We are pleased that the FTC has obtained the necessary and timely approval to permit the generic versions of Viagra, which are both brand-name and generic products, to be sold by mail in the US.”
The complaint says that while the FDA has requested the generic versions of the drug to be sold at retail prices in the US, they are being sold at a much higher rate than the branded product.
The suit claims that the “price of prescription drugs sold to patients who are not eligible for free prescription drugs is being paid by the FDA to treat the conditions described in section 505(a) of the Federal Food, Drug, and Cosmetic Act”.
FDA Commissioner Daniel Williams said that “the appropriate rate of price is the price determined by the FDA under the law of the state in which the drug is sold, and it is the Federal government which has the right to negotiate prices with the pharmaceutical companies,” adding that the drug will be available for purchase in the US.
The complaint also alleges that the company was engaged in unfair competition when it sold the drug without the FDA’s approval, that the generic version is “substantially equivalent to the original product”, and that it is “clearly a violation of the Trade Marks Act”. The complaint further alleges that the generic version of Viagra is being sold by mail in the US at a higher price than the branded product.
The complaint is being filed by an attorney for Eli Lilly and Company, as well as by the firm of Kirkman & Ellis, LLP, and is in the first quarter of 2019. The lawsuit was filed in the US District Court for the Northern District of California.
The FDA has also sought approval to sell the generic version of Viagra at a lower price.
The suit was filed by the plaintiff in the lawsuit on the grounds that the generic version is “not substantially equivalent to the original product,” and that the generic is being sold by mail.
“We believe that the FDA, as a regulator, should consider all of the factors mentioned in its order and consider whether it would allow the generic versions of Viagra to be sold at retail prices in the US by mail,” the company said.
“We expect that the decision will be made in a timely manner and that any additional action will allow the FDA to consider the final aspects of its order, including whether the generic version of Viagra is substantially equivalent to the original product.”
